Contracts

  • Aided corporate construction client in minimizing risk and avoiding two threats of significant litigation through the drafting and defending of commercial contracts, employment agreements, policy manuals and company procedures.
  • Drafted and enforced non-compete documents and facilitated corporate client’s release of employee for violation thereof, avoiding threatened litigation for wrongful termination.
  • Obtained dismissal of $335,000,000 breach of contract claim against corporate client based upon forum selection and choice of law provisions.
  • Drafted property purchase agreements, admissions applications, waivers, employment documents, water use agreements, lease agreements, and other corporate documents for client, facilitating exponential growth while minimizing legal risk at residential treatment facility.

Employment

  • Defended high six-figure wrongful termination claim alleged against corporate client youth facility, allowing client to pay de minimis settlement, saving hundreds of thousands of dollars.
  • Negotiated favorable settlement in wrongful termination suit, arriving at settlement of less than 1/15th of the original high six-figure claim, allowing corporate client to maintain reputation and insurance levels with no increased premium.
  • Represented corporate client in proceedings before the Utah Labor Commission to resolve alleged wrongful termination claim, enabling client to pay de minimis monetary sum to former employee.
  • Aided President of a prestigious technical college in return to job after wrongful termination.

Real Estate

  • Drafted complex lease and purchase documents for extended family group in division of large family homestead.
  • Aided client in trespass and property rights action against commercial developer, allowing client to regain control over property, stop trespasses, and obtain substantial sum of money in settlement.

Other

  • Facilitated highly-favorable settlement in favor of corporate client based upon defamatory internet-based statements of others; settlement included monetary payments to client, sale of defamatory website to client, removal of defamatory content from blogs and other internet media sources, and public apology.
  • Aided insurance company client against low six-figure fire and vandalism claims by demonstrating evidence of insurance fraud through risk assessment, claims investigation, and significant research.
  • Researched and advised on regulatory risk and compliance for client, facilitating exponential growth while minimizing legal risk at high-risk youth residential treatment facility.
