3 Tips to Protect Your Trademark
Protecting your trademark begins the second you dream up a name, logo, or slogan for your brand. Here are a few tips to help make sure you start on solid footing and keep your trademark strong.
Ensure it’s Unique
- Trademarks must be distinct within their industry
- Conduct a thorough search to ensure your mark stands out
Put it to Use
- To hold power, a trademark must be used in commerce
- Don’t just dream it up—connect it to your goods and services
Get it Registered
- Federal registration amplifies your trademark rights
- Provides you with exclusive use of your mark nationally
Why Register Your Trademark?
Trademark registration is the most straightforward way to secure broad protection for your mark.
While you earn trademark rights when you use the mark in commerce, registering with the USPTO takes those rights from the regional stage to the national one. It places your mark in a public database, decreasing the risk of others claiming it as their own (and giving you a clear path for recourse if they do).
A few benefits of federal registration:
Use of registered symbol ®
Exclusive rights nationwide
Sue for infringement in federal court
Easy-to-find proof of ownership

Frequently Asked Questions
A trademark can last forever as long as you maintain the proper paperwork trail. Your first renewal period opens up five years after registration. Your next renewal period opens at year nine. Every 10 years that follow, you’ll have more renewals due. There’s no limit on the number of possible federal trademark renewals.
The base fee to file a federal trademark application is $350, which includes registration in one trademark class. Your USPTO fee goes up by $350 for every class you add.
The USPTO says to expect a minimum of 10 months for your trademark to be registered after your initial application is received. However, this is an estimate and registration is not guaranteed.
An office action is an issue with a trademark application raised by the examining attorney. Office actions can be simple filing errors or complicated, nuanced issues. We do everything we can to minimize the potential for office actions and alert you ahead of time to possible problems as we see them. But if they arise, we’ll provide recommendations for how to proceed, and even cover certain office action responses as part of our standard service offering.
